Refusal of Unauthorized Email Collection

01 Article 50-2 of the Act on Promotion of Information and Communications Network Utilization and Information Protection (Prohibition of Unauthorized Collection of Email Addresses)
  • No person shall collect email addresses using any program or other technical means that automatically collects email addresses from websites on which a notice refusing such collection is explicitly posted.
  • No person shall sell or distribute email addresses collected in violation of Paragraph 1.
  • No person shall use email addresses for the transmission of information if he or she knows that the collection, sale, or distribution of such addresses is prohibited under Paragraphs 1 and 2.
02 Article 65-2 of the Act on Promotion of Information and Communications Network Utilization and Information Protection (Penalties)

Any person falling under any of the following subparagraphs shall be subject to a fine not exceeding ten million Korean won:

  • A person who takes technical measures in violation of Article 50, Paragraph 4
  • A person who transmits commercial advertising information for profit in violation of Article 50, Paragraph 6
  • A person who collects, sells, distributes, or uses email addresses for the transmission of information in violation of Article 50-2
